Terms of Service

Last updated: 5 October 2026

The short version

• CONTEXTURE is a synthesizer plug-in (AU, VST3 and Standalone) for macOS and Windows. By using it you agree to these Terms.

• You buy a one-time, perpetual licence, sold by Paddle.com, our Merchant of Record.

• The plug-in activates online against our licence server and can run on up to 2 of your devices at once. You manage your devices in your account.

• CONTEXTURE processes audio on your computer — we never receive your music or projects.

• Refunds are available before you activate the plug-in; after activation the product is considered used — see the Refund Policy.

1. Who we are and how these Terms apply

These Terms of Service (the “Terms”) are a binding agreement between you and Distrib by Yamka LLP (TOO «Distrib by Yamka»), a limited liability partnership registered in the Republic of Kazakhstan, BIN 260840024988 (“CONTEXTURE”, “we”, “us”, “our”). They govern your access to and use of the CONTEXTURE plug-in and standalone application for macOS and Windows, the website contextureaudio.com, our licence and account servers and all related services (together, the “Service”).

By downloading, installing, activating or using the Service, creating an account or purchasing a licence, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy and Refund Policy, which form part of these Terms. If you do not agree, do not use the Service.

Company details: Distrib by Yamka LLP (TOO «Distrib by Yamka»), a limited liability partnership registered in the Republic of Kazakhstan. Business Identification Number (BIN): 260840024988. Registered address: 28 Zhuravleva St., building 3, apt. 334, floor 12, Almaty, Republic of Kazakhstan. Director: Vladimir Orekhov. Email: [email protected].

2. Definitions

  • Account — your CONTEXTURE account, created with a confirmed email address and a password.
  • Licence — the perpetual right to use CONTEXTURE that you receive when you purchase it.
  • Activation — associating your Licence with a device so the plug-in runs on it.
  • Device — a computer on which CONTEXTURE is activated, recognised by a device identifier (see section 5).
  • Host — a DAW or other application that loads the plug-in (AU/VST3), or the Standalone application.

3. Eligibility

You must be at least 18 years old to buy a Licence and use the Service. You may not use the Service if you are barred from receiving it under applicable law, including export-control and sanctions laws, or if we have previously terminated your Account for a breach of these Terms.

4. Your Account and its security

To manage your Licence you create an Account with an email address that belongs to you and can receive mail (you confirm it by email), and a password. We store only a secure one-way hash of your password, never the password itself. You may enable two-factor authentication (2FA) for extra security.

You are responsible for keeping your login details and devices secure and for all activity under your Account. Tell us immediately at [email protected] if you believe your Account has been used without permission. You may not sell, transfer or share your Account or Licence, or create multiple accounts to get around activation limits.

5. The Licence, activation and devices

When you purchase CONTEXTURE you receive a perpetual, personal, non-exclusive, non-transferable licence to install and use the plug-in and Standalone application on devices you own or control, solely for your own music production.

CONTEXTURE activates online against our licence server. Your Licence can be active on up to 2 devices at the same time. You can remove a device from your Account at any time to free a slot. After activation the plug-in keeps working offline; from time to time, when online, it re-checks your Licence with our server.

To enforce the Licence we create a device identifier — a one-way hash derived from your computer’s hardware ID. It cannot be reversed to read your hardware details and is used only to recognise and count your activated devices. See the Privacy Policy for details.

If you change or replace your computer, reconnect it to the internet so the plug-in can re-activate on the new device (removing an old device first if both slots are used).

6. The Service and your setup

CONTEXTURE is a software instrument. To use it you need a supported version of macOS (Apple Silicon or Intel) or Windows and either a Host that supports AU or VST3, or you can run the Standalone application. Your operating system, DAW and any third-party software are not part of the Service and are governed by their own licences and terms.

All audio synthesis and processing happens locally on your computer. CONTEXTURE does not send your audio, projects, presets or performances to us. The only data that reaches our servers is what is needed to run your Account and Licence (see the Privacy Policy).

We continuously improve the Service and may add, change or remove features and supported versions of macOS, Windows or plug-in formats. The Service may contain bugs; keep backups of your projects as you would with any software.

7. Payments

CONTEXTURE is a one-time purchase. Our order process is conducted by our online reseller Paddle.com, which is the Merchant of Record for all our orders. Paddle handles payment, invoicing, customer-service inquiries about billing, and returns, and calculates and collects applicable sales tax and VAT. When you buy a Licence you buy it from Paddle, and Paddle’s Buyer Terms and privacy policy apply to the purchase. Prices are shown at checkout and include applicable taxes.

8. Licence restrictions and acceptable use

You agree not to, and not to help anyone else to:

  • share, resell, sublicense, rent or distribute your Licence, or use it on more devices than allowed;
  • bypass, disable, tamper with or circumvent licence activation, verification or any technical protection;
  • copy, modify, decompile, reverse engineer or create derivative works of the Service, except to the extent such restrictions are prohibited by law;
  • use the Service to build a competing product, or for any unlawful, fraudulent or infringing purpose;
  • probe, scan or test the security of our servers, or place an unreasonable load on them, except under a responsible-disclosure arrangement agreed with us in advance.

If you discover a security vulnerability, please report it privately to [email protected] and give us reasonable time to fix it before disclosing it.

9. Software, updates and anti-piracy

The plug-in may check for and install updates; updates are digitally signed and verified before installation. Older versions may stop working with the licence server over time.

We may record security events (for example signs of tampering, or a Licence used on more devices than allowed) to protect against piracy and fraud. In cases of clear abuse or fraud we may flag or revoke a Licence; we review such cases individually and do not automatically penalise legitimate users. A Licence refunded or charged back may be revoked.

10. Third-party services and trademarks

The Service relies on third parties, including Paddle (payments), Supabase (accounts, database and licence functions), Cloudflare (website delivery, security and the API endpoint) and Resend (transactional email). We are not responsible for third-party services, which are governed by their own terms.

VST is a trademark of Steinberg Media Technologies GmbH. Audio Units, Mac and macOS are trademarks of Apple Inc. Windows is a trademark of Microsoft Corporation. CONTEXTURE is an independent product and is not affiliated with, endorsed or sponsored by these companies. All other trademarks belong to their respective owners.

11. Suspension and termination

You may stop using the Service at any time by uninstalling the software. To delete your Account and associated data, use the control in your account or write to [email protected].

We may suspend or revoke a Licence or terminate your Account, with or without notice, if you breach these Terms, if required by law, or if your use creates a security or legal risk. Where reasonable we will tell you why.

Sections that by their nature should survive termination — including 8 to 10 and 12 to 16 — survive.

12. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free or compatible with your system, Host or other software. Nothing in these Terms limits rights you have as a consumer that cannot be limited or excluded under the law of your country of residence.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, projects, recordings or other intangible losses, arising out of or related to the Service. To the maximum extent permitted by law, our total liability for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid for the Licence in the 12 months before the event giving rise to the claim, and (b) USD 50. These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or intentional misconduct or gross negligence.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses and expenses (including reasonable legal fees) brought by third parties arising from your breach of these Terms or your violation of any law or third-party rights. This section does not apply to consumers where such indemnities are not permitted.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-laws rules. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence. Before starting any formal proceedings, please contact us at [email protected] so we can try to resolve the dispute informally within 30 days. Disputes about payments, billing and refunds may also be raised with Paddle as the Merchant of Record.

16. Export controls and sanctions

You may not use or export the Service in violation of applicable export-control or sanctions laws. Paddle may be unable to accept payments from certain countries, in which case the Licence is not available there.

17. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date. If a change materially affects your rights, we will notify you by email or in the app at least 14 days before it takes effect, unless the change is required by law or addresses security.

18. General

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are written in English; translations are provided for convenience, and the English version prevails. Parts of the CONTEXTURE software, website and these documents were prepared with the help of AI tools and reviewed by us.

19. Contact

Questions about these Terms: [email protected]. Billing questions for purchases can also be sent to Paddle via paddle.net.

Privacy Policy

Last updated: 5 October 2026

The short version

• We collect as little as possible: your email, a password hash, an account ID, your licence and the devices it’s activated on, and short-lived security logs.

• CONTEXTURE processes audio on your computer — we never receive your music, projects or presets, and never train AI on anything.

• No analytics, no advertising, no tracking cookies. We don’t sell or share your data.

• Payments are handled by Paddle, which keeps your card details. We store only the purchase and transaction IDs and status.

• You can access, correct or delete your data at any time: [email protected].

1. Who is responsible for your data

This Privacy Policy explains how Distrib by Yamka LLP, a limited liability partnership registered in the Republic of Kazakhstan, BIN 260840024988 (“CONTEXTURE”, “we”, “us”), collects, uses and protects personal data when you use the CONTEXTURE software, the website contextureaudio.com and related services (the “Service”). We are the controller of the personal data described here, except for payment data, which Paddle controls as Merchant of Record (section 4).

Contact for all privacy matters, including requests under the GDPR, UK GDPR, CCPA/CPRA and the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”: [email protected]. Company details as in the Terms, section 1.

2. Data we process

Account data: your email address and when you confirmed it; a secure one-way hash of your password (never the password itself); a random account ID; and, if you enable two-factor authentication, your TOTP factor record.

Licence and activation data: your licence status, the maximum number of devices, any expiry, and the Paddle customer and transaction IDs linked to your purchase; for each activated device, a device identifier and the dates it was first and last seen.

Device identifier: to enforce your licence we create a one-way hash (SHA-256, with a fixed salt) derived from your computer’s hardware ID. It cannot be reversed to read your hardware details; it only lets us recognise and count the devices your licence is active on.

Security data: technical events needed to protect the Service — for example the IP address seen when the plug-in or website contacts our licence server, and anti-piracy signals such as licence-tampering or device-mismatch events. Login/sign-in to the website creates a session record (a hashed session identifier, when it was created and last used).

Support data: if you email us, your email address, your message and anything you include.

Waitlist: if you sign up on the website to be notified at launch, your email address.

We do not receive your audio, projects, presets or performances; they stay on your computer. We do not collect special categories of data, precise location, contacts, microphone or camera data.

3. Why we use it and our legal bases

  • To create and run your Account and Licence, activate the plug-in on your devices and apply device limits — performance of our contract with you (GDPR Art. 6(1)(b)).
  • To confirm your email, sign you in and keep the Service secure, prevent fraud, piracy and brute-force attempts, and fix errors — our legitimate interests (Art. 6(1)(f)).
  • To process your purchase and link it to your Account — performance of a contract; Paddle processes the payment itself.
  • To answer your requests and send essential service messages (for example about changes to Terms) — contract and legitimate interests.
  • To comply with legal obligations such as tax and accounting — legal obligation (Art. 6(1)(c)).
  • Where the law of Kazakhstan requires consent, by installing the software and creating an Account you consent to the processing described here; you can withdraw consent by deleting your Account.

We do not use your data for advertising, profiling or automated decisions with legal effect, and we do not use anything to train machine-learning or AI models.

4. Payments

Purchases are sold by Paddle.com Market Limited (“Paddle”), which acts as Merchant of Record and as an independent controller of the data you give it at checkout: name, email, billing address, country, payment-method details and tax information. Paddle’s privacy policy applies to that data (paddle.com/legal/privacy). Paddle sends us, through signed webhooks, only what is needed to activate and manage your Licence: customer and transaction IDs, product, status, amounts and currency. We never receive or store your card details.

5. Who we share data with (sub-processors)

We share personal data only as needed to run the Service:

  • Supabase (database, authentication and licence functions) — hosted in the Asia-Pacific (Sydney) region;
  • Cloudflare, Inc. (USA) — website delivery, our API endpoint (api.contextureaudio.com), bot/abuse protection (Turnstile) and email routing;
  • Resend, Inc. (USA) — delivery of confirmation, sign-in and notification emails;
  • Paddle — payments, as an independent controller;
  • professional advisers, auditors and authorities where required by law, to protect rights and safety, or in connection with a merger or acquisition (with notice to you).

We self-host our website fonts, so no font provider receives your IP address. We do not sell personal data and do not “share” it for cross-context behavioural advertising as defined in California law.

6. Website, cookies and similar technologies

contextureaudio.com uses no analytics, advertising pixels or tracking cookies, and we honour Global Privacy Control and Do Not Track by default because we do not track. The site is delivered through Cloudflare, which may set strictly necessary security cookies (for example to detect bots). If you sign in to your account, we keep you signed in using your browser’s local storage (a functional token), not a tracking cookie. The bot-protection widget (Cloudflare Turnstile) loads on the sign-in page and with the email sign-up form for fraud prevention.

7. International transfers

Our database is hosted in Australia (Sydney), the Service is operated from the Republic of Kazakhstan, and some providers are in the United States. Where personal data is transferred outside the European Economic Area or the United Kingdom, we rely on adequacy decisions or Standard Contractual Clauses, with additional safeguards where appropriate.

8. How long we keep data

  • Account, licence and activation data — while your Account exists; you can ask us to delete it at any time. Accounts inactive for a long period may be deleted.
  • Purchase records — as long as needed for accounting, tax and legal claims (typically up to 5 years), unless the law requires longer.
  • Email confirmation and sign-in links — short-lived (minutes) and single-use. Website sign-in sessions — until you sign out or after a period of inactivity.
  • Security logs with IP addresses — a short period (up to about 14 days); anti-abuse counters — briefly, mostly in memory.
  • Support emails — up to 24 months after the conversation ends. Waitlist email — until you unsubscribe or we complete the launch announcements.

9. Security

We protect data with measures appropriate to the risk, including: TLS encryption for all connections; storing only a hash of your password and of login tokens; row-level security on our database so one account cannot read another’s data; signed, verified software updates; rate limits and bot protection against guessing and brute-force; and access to production systems limited to the people who operate the Service. No system is perfectly secure; if a breach is likely to put your rights at risk, we will notify you and the competent authorities as required by law.

10. Your rights

Depending on where you live, you may have the right to access, correct, delete or port your data, to restrict or object to processing based on legitimate interests, to withdraw consent, not to be discriminated against for exercising your rights, and to lodge a complaint with a data-protection authority (for example in your EU/EEA country, the UK ICO, or the authorised body in Kazakhstan). To exercise your rights, email [email protected] from your account email; we may ask to verify your identity and respond within one month (or the period required by your local law).

11. Children

The Service is intended for people aged 18 and over and is not directed to children. We do not knowingly collect personal data from children; if you believe a child has provided data to us, contact us and we will delete it.

12. Changes to this policy

We may update this Privacy Policy. We will post the new version here with a new “Last updated” date and, for significant changes, notify you by email or in the app before they take effect.

13. Contact

Privacy questions and requests: [email protected].

Refund Policy

Last updated: 5 October 2026

The short version

• Full refund within 14 days as long as you have not activated CONTEXTURE on any device.

• Once you activate the plug-in, the Licence is considered used and is non-refundable.

• Refunds are processed by Paddle, our Merchant of Record, back to your original payment method.

1. Who processes refunds

Our order process is conducted by our online reseller Paddle.com, the Merchant of Record for all our orders. Paddle handles billing customer service and returns. This policy explains when we agree to refunds; Paddle’s Buyer Terms also apply to your purchase.

2. Before activation — 14-day money-back

If CONTEXTURE is not right for you, you can request a full refund within 14 days of purchase, provided you have not activated the plug-in on any device. You do not have to give a reason. After the refund is issued, your Licence is cancelled.

3. After activation

Activation unlocks the full, usable product on your computer. For that reason, once the Licence has been activated on any device it is considered used and is non-refundable. Our records of your activations show whether and when this happened.

4. Consumers in the EU, EEA and UK

If you are a consumer in the EU, EEA or UK, you normally have a 14-day right to withdraw from a purchase of digital content. Because CONTEXTURE is downloadable digital content made available immediately, at checkout you are asked to expressly request immediate access and acknowledge that you lose the right of withdrawal once you activate the plug-in. Until you activate, your 14-day withdrawal right is fully honoured and you can obtain a full refund. Nothing in this policy limits other mandatory consumer rights you have under the law of your country.

5. How to request a refund

Use the link in your Paddle receipt email, or find your order at paddle.net using the email address you used at checkout; or write to [email protected] from that address with your order number if possible. We aim to confirm eligible refunds within 2 business days. Paddle returns the money to your original payment method, usually within 5–10 business days, including taxes.

6. Discretion and technical faults

Even after activation, we may issue a full or partial refund at our discretion — for example if a technical problem on our side prevented you from using the product and we could not resolve it.

7. Abuse and chargebacks

We may refuse a refund where the law allows and there is clear evidence of abuse — for example repeated purchase-and-refund cycles or fraudulent payments — or where your Account was terminated for a serious breach of the Terms. This does not affect mandatory consumer rights. If you believe a charge is incorrect, please contact us or Paddle before disputing it with your bank; opening a chargeback may suspend your Licence while the dispute is reviewed.

8. Contact

Refund questions: [email protected], or Paddle via paddle.net.
